One notary visit instead of two witnesses

In Washington, a power of attorney or healthcare directive can be signed in one of two ways: in front of a notary, or in front of two qualified witnesses. You don't need both.

Finding two qualified witnesses is often harder than it sounds. Family members, people named in the document, and, depending on the document, caregivers and healthcare staff can't serve. A notary visit avoids that problem entirely.

Notarization also helps after the signing. Washington law presumes a notarized POA signature is genuine and gives extra protection to banks and others who accept a notarized POA in good faith. In practice, a notarized POA tends to be accepted with fewer questions.

Documents we notarize

  • Durable power of attorney (financial)

  • Healthcare power of attorney

  • Healthcare directives (living wills)

  • Limited and specific-purpose POAs, such as for a real estate sale or vehicle

  • POA revocations

  • Powers of attorney for a minor child

We don't draft documents or advise on which one you need. An estate planning or elder law attorney can, and many offer quick turnaround for urgent situations. Washington also publishes standard healthcare directive forms many families use.

Before your appointment

1. Bring the completed, unsigned document. All blanks should be filled in except the signatures. Signing has to happen in front of the notary.

2. Bring valid photo ID. A driver's license, state ID or passport. Washington accepts IDs that expired within the last three years.

3. The signer must understand and agree. The person granting the POA must sign willingly and understand what they're signing. If they're ill or hospitalized, pick a time of day when they're most alert. If capacity is in question, talk to an attorney before booking.

4. The agent doesn't need to be there. The person being given authority usually doesn't have to attend. Check your document or ask your attorney if you're unsure.

Frequently asked questions

Q: Do I need witnesses if my POA is notarized?
A: Not under Washington law. Notarization or two qualified witnesses is enough. If your document has witness lines, ask your attorney whether to use them anyway.

Q: Can my son or daughter witness my POA?
A: No. Relatives of the signer or the agent can't witness a Washington POA. That's one reason notarization is easier.

Q: Can you notarize a POA for someone in the hospital?
A: Yes, as long as the signer is alert and signing willingly. See our [Hospital & Care Facility Notary] page.

Q: Will my bank accept a notarized POA?
A: Most do, but some banks and brokerages prefer their own forms. Call them before your appointment.

Q: Does a will need a notary?
A: Washington wills are witnessed, not notarized, so ask your attorney about the signing requirements.
